By accessing, requesting, receiving, downloading, viewing, using, or interacting with any Industrial Reality Index material, each reader, recipient, organization, executive, board member, investor, lender, insurer, advisor, employee, contractor, representative, or other user agrees to comply with these Terms and Conditions.

The Industrial Reality Index is a proprietary recurring benchmark and research publication examining enterprise reality across organizations, industries, jurisdictions, and time.
It includes proprietary observations, classifications, comparative methodologies, analytical frameworks, benchmarks, scores, Executive Previews, research outputs, and related materials developed and published under CEO 2028 OS by Florian Brach Executive Search LLC.
The Industrial Reality Index is designed to make recurring organizational realities comparable and to identify patterns that may remain invisible to conventional reporting, financial results, hierarchy, management narratives, surveys, and one-time assessments.
Publisher and Ownership
The Industrial Reality Index is published under CEO 2028 OS, the enterprise control system behind the Index.
The Industrial Reality Index, CEO 2028 OS, the Industrial Reality Score, all Executive Previews, reports, benchmark structures, classifications, observation frameworks, analytical approaches, publication formats, supporting research, and related intellectual property are owned exclusively by Florian Brach Executive Search LLC, except where expressly stated otherwise in writing.
CEO 2028 OS provides the underlying enterprise control system, observation environment, and research infrastructure supporting the development and publication of The Industrial Reality Index.
All rights in the Index, its publications, its underlying research infrastructure, and its proprietary methodology remain exclusively with Florian Brach Executive Search LLC.
Access and Permitted Use
Public website materials may be accessed for personal, professional, and internal informational review, subject to these Terms.
Executive Previews, confidential reports, private briefings, unreleased materials, and other restricted publications are provided only to the specifically authorized recipient or organization for the purpose stated at the time of access or distribution.
Access to restricted materials is limited, revocable, nonexclusive, and nontransferable.
No recipient may provide access to another person, organization, advisor, consultancy, service provider, media organization, or other third party without prior written consent from Florian Brach Executive Search LLC.
Florian Brach Executive Search LLC retains full discretion over granting, limiting, conditioning, suspending, or withdrawing access to any nonpublic Index material.
Executive Previews and Restricted Materials
Executive Previews and other materials identified as confidential, restricted, preliminary, private, prerelease, or not intended for public circulation are provided solely for restricted review.
Unless expressly authorized in writing, such materials may not be:
- shared or forwarded;
- published or redistributed;
- quoted or attributed publicly;
- provided to the press or media;
- summarized for external circulation;
- uploaded to public or third-party platforms;
- incorporated into presentations, reports, publications, or advisory materials;
- provided to consultants, advisors, analysts, service providers, law firms, investment banks, or other third parties;
- or used for any purpose beyond the authorized review.
Restricted materials remain subject to these obligations regardless of whether they were delivered by email, website access, PDF, presentation, briefing, printed copy, or another format.
Preliminary observations, benchmarks, classifications, and findings may be revised, expanded, reclassified, or withdrawn before publication of the full Index.
Intellectual Property
The Industrial Reality Index, including its name, publications, Executive Previews, written content, observations, language, graphics, layouts, document structures, benchmark formats, classifications, analytical frameworks, research outputs, scores, and related materials, is protected intellectual property.
All copyrights, trade-secret rights, database rights, trademark rights, contractual rights, and other proprietary rights are reserved by Florian Brach Executive Search LLC.
Access to or receipt of Index materials does not transfer ownership, provide a license to the underlying methodology, disclose proprietary know-how, or grant any right to reproduce, commercialize, adapt, imitate, or build upon the Index or any part of it.
No rights are granted except the limited right to review authorized materials for the permitted purpose.
All rights not expressly granted are reserved.
Industrial Reality Index Methodology
The Industrial Reality Index Methodology is the proprietary process through which organizational observations and signals are selected, reconstructed, structured, interpreted, classified, compared, benchmarked, scored, and prepared for publication.
The methodology is supported by CEO 2028 OS and may include proprietary observation frameworks, longitudinal reconstruction approaches, analytical structures, classifications, comparison models, research processes, benchmark designs, scoring principles, and publication methods.
The complete methodology is not disclosed through the website, Executive Previews, Index publications, briefings, benchmark results, or any other materials.
Access to any Index material does not grant any right to:
- identify or extract the underlying methodology;
- reconstruct how observations or benchmarks were derived;
- replicate the observation or comparison process;
- validate or reverse engineer the methodology;
- derive competing classifications, benchmarks, scores, or research systems;
- or create any internal or external substitute based on the Index.
The Industrial Reality Index Methodology, including all undisclosed processes, techniques, structures, classifications, selection criteria, comparison approaches, scoring principles, and related know-how, remains confidential and proprietary to Florian Brach Executive Search LLC.
Research Basis and Limitations
The Industrial Reality Index is based on observation, reconstruction, analysis, and comparison of organizational and operating realities across selected contexts.
The Index is not represented as a census of all companies, sectors, jurisdictions, or operating environments.
The selection criteria, observation basis, classifications, comparative method, and analytical scope may vary between editions, volumes, previews, sectors, and research contexts.
Findings may be based on incomplete, changing, historical, anonymized, aggregated, confidential, or context-specific information.
Preliminary findings may differ from findings included in later or full editions.
No recipient may represent that the Index establishes universal causation, predicts a specific organizational outcome, or provides a complete assessment of any company, sector, or market unless expressly stated in the relevant publication.
Industrial Reality Score
The Industrial Reality Score, including its name, structure, composition, classifications, calculation approach, weighting principles, benchmark logic, interpretation, and associated methodologies, constitutes proprietary intellectual property of Florian Brach Executive Search LLC.
No access or use right is granted to reproduce, approximate, calculate, emulate, modify, validate, reverse engineer, benchmark against, or develop any competing or derivative score based on The Industrial Reality Index or related materials.
No person or organization may publicly assign, estimate, represent, or publish an Industrial Reality Score for any organization without prior written authorization from Florian Brach Executive Search LLC.
Confidentiality
All nonpublic Index materials, Executive Previews, prerelease publications, private briefings, research materials, benchmark information, classifications, observations, methodologies, score-related information, and related communications are confidential.
Recipients shall protect confidential Index materials using at least reasonable care and no less than the degree of care used to protect their own most sensitive confidential information.
Confidential materials may not be disclosed, copied, reproduced, distributed, published, summarized for external use, taught, demonstrated, transmitted, or made available to any third party without prior written consent from Florian Brach Executive Search LLC.
No recipient may remove, obscure, crop, alter, or conceal any confidentiality notice, copyright notice, document identifier, watermark, attribution, distribution restriction, publisher statement, or proprietary marking.
Confidentiality obligations survive the termination, expiration, withdrawal, or completion of access.
Restricted Use
No person or organization may, directly or indirectly:
- copy, reproduce, adapt, modify, translate, publish, distribute, license, sell, transfer, commercialize, or create derivative materials from The Industrial Reality Index;
- systematically extract observations, findings, classifications, benchmark data, scores, document structures, or other Index content;
- use Index materials to create or support a competing benchmark, research publication, database, scoring system, advisory product, software product, operating model, methodology, or commercial service;
- use Index materials for comparative benchmarking of the Index itself or its methodology;
- deconstruct, reverse engineer, infer, extract, approximate, or replicate the Index methodology;
- combine Index materials with other information for the purpose of recreating its research, classification, comparison, or scoring approach;
- use confidential or restricted materials in external consulting, advisory, investment, underwriting, transaction, diligence, credit, insurance, media, or research work without prior written consent;
- or misrepresent any Index observation, preliminary finding, classification, score, benchmark, or statement.
Use of publicly available Index materials does not permit systematic copying, commercial republication, methodology extraction, or development of competing or derivative products.
No Implied Transfer of Know-How
Access to The Industrial Reality Index does not transfer any underlying know-how, trade secret, research method, observation model, analytical approach, classification system, benchmark design, scoring methodology, operating concept, or proprietary intellectual structure.
Exposure to Index materials does not grant any right to internalize, codify, operationalize, reproduce, teach, or use the underlying methodology as an internal process, advisory framework, investment model, research method, software system, or commercial product.
AI and Model Training Restriction
No person, organization, recipient, user, or third party may upload, paste, feed, transmit, or otherwise provide any nonpublic or restricted Index material to an external artificial intelligence system, machine learning system, large language model, automated analysis platform, or similar technology without prior written consent from Florian Brach Executive Search LLC.
No Index material, whether public or nonpublic, may be used to train, fine-tune, instruct, validate, test, benchmark, improve, ground, augment, or support any machine learning model, large language model, automated decision system, research system, or algorithmic product without prior written consent.
No AI system may be used to extract, reconstruct, approximate, infer, emulate, summarize for redistribution, or develop derivative versions of:
- the Index methodology;
- the Industrial Reality Score;
- the classifications or benchmark structure;
- the observation and comparison approach;
- the research database;
- Executive Previews;
- or related proprietary materials.
Use of generally available AI tools for ordinary personal reading assistance does not authorize disclosure of confidential materials, systematic extraction, redistribution, derivative development, or any use otherwise prohibited by these Terms.
Citation and Attribution
Publicly released Industrial Reality Index materials may be cited only accurately, in context, and with appropriate attribution.
Unless a publication specifies another format, the preferred attribution is:

Where an edition, volume, jurisdiction, year, Executive Preview, or document identifier is available, it should be included.
No citation may imply endorsement, partnership, validation, sponsorship, or approval by The Industrial Reality Index, CEO 2028 OS, Florian Brach, or Florian Brach Executive Search LLC.
No preliminary, confidential, restricted, prerelease, or private material may be quoted, cited, summarized, attributed, or referenced publicly without prior written consent.
Permitted citation does not include substantial reproduction, systematic extraction, republication, commercial reuse, or use of Index content to create competing or derivative work.
Briefings and Communications
Executive briefings and related communications may include confidential interpretations, preliminary observations, contextual analysis, or discussion of how Index findings may relate to a specific organization, transaction, governance matter, investment context, or risk environment.
Unless otherwise agreed in writing, briefings are informational discussions and do not constitute consulting, legal advice, investment advice, audit services, credit advice, insurance advice, regulatory advice, or a complete organizational assessment.
No recording, transcription, automated capture, AI processing, quotation, redistribution, or external summary of a private briefing is permitted without prior written consent from Florian Brach Executive Search LLC.
No Reliance and Professional Advice
The Industrial Reality Index provides research observations, comparative information, benchmarks, classifications, and analytical perspectives.
It does not constitute legal, accounting, audit, tax, regulatory, employment, investment, lending, insurance, underwriting, transaction, valuation, or other regulated professional advice.
Recipients remain solely responsible for conducting their own analysis and obtaining appropriate professional advice before making any decision.
No decision should be based solely on The Industrial Reality Index, an Executive Preview, an Industrial Reality Score, a briefing, or any related material.
No Warranty
The Industrial Reality Index and all related materials are provided as is and as available.
Florian Brach Executive Search LLC does not warrant that any publication, observation, benchmark, classification, score, comparison, forecast, or other material is complete, error-free, universally applicable, or suitable for any specific purpose.
No warranty is made regarding the availability, timing, content, scope, or release date of any future edition, Executive Preview, benchmark, score, publication, or briefing.
References to expected publication dates, future editions, planned topics, or anticipated content are subject to change without notice.
Limitation of Liability
To the maximum extent permitted by law, Florian Brach Executive Search LLC, CEO 2028 OS, Florian Brach, and their respective representatives shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or financial damages arising out of or relating to The Industrial Reality Index or any related material or communication.
This includes loss of revenue, profits, opportunity, business, investment value, goodwill, data, anticipated savings, or reputation.
To the maximum extent permitted by law, aggregate liability arising out of or relating to The Industrial Reality Index shall not exceed the fees paid specifically for the relevant Index material or service during the twelve months preceding the event giving rise to the claim or, where no fee was paid, one hundred U.S. dollars.
These limitations apply regardless of the legal theory asserted, except to the extent prohibited by applicable law.
Remedies and Injunctive Relief
Unauthorized disclosure, copying, extraction, redistribution, commercial use, methodology reconstruction, score replication, AI use, competitive use, or creation of derivative research or products may cause irreparable harm for which monetary damages alone would be inadequate.
Florian Brach Executive Search LLC may seek injunctive relief, equitable relief, damages, attorneys’ fees, and all other remedies available under applicable law and contract.
Any unauthorized use may also result in immediate withdrawal of access and exclusion from future publications, briefings, previews, or related services.
Updates and Future Publications
These Terms may be updated from time to time.
The version published on the official Industrial Reality Index website governs access to materials from the effective date shown, unless a separate written agreement provides otherwise.
Individual publications, Executive Previews, reports, or briefings may contain additional restrictions, confidentiality notices, document classifications, or permitted-use conditions.
Such document-specific restrictions supplement these Terms.
Governing Law and Venue
These Terms and any dispute arising out of or relating to The Industrial Reality Index, CEO 2028 OS, any Index material, or any related access or use shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any action or proceeding shall be brought exclusively in the state or federal courts located in Florida, and the parties consent to the jurisdiction and venue of those courts.
Entire Agreement
These Terms govern access to and use of The Industrial Reality Index and may be supplemented by a confidentiality agreement, access agreement, briefing agreement, order form, service agreement, license agreement, or other written terms.
In the event of conflict, the more specific signed agreement controls unless it expressly states otherwise.
